Definitions

  1. The regulations introduced in this document specify the terms and conditions of use of the Dolfi1920.de webpage, in particular the rights and obligations of registered Users of Dolfi1920.de
  2. When these regulations refer to:
    1. Dolfi1920 - Dolfi1920 GmbH, Commercial Register Number: HRB 77460, Commercial Register B District Court: Frankfurt, Ust-Id: DE814489733
    2. Website - the web portal Dolfi1920.de available at the Internet address: http://dolfi1920.de, operated by Dolfi1920, on the terms specified in General Terms and Conditions Regulations.
    3. User - a person with full legal capacity who, by accepting General Terms and Conditions Regulations, has gained access to Dolfi1920 services.
    4. Login – the individual and unique e-mail address being the unique ID of the User on the Website.
    5. Password - a string of at least 8 characters defined by the User and assigned to the User. The User is required to enter the password to access the Website.
    6. Account - a set of services offered on the Website together with individual User settings enabling the User to use the Website.
    7. Registration - a one-off operation consisting of setting up an Account by the User, by using the registration form provided by Dolfi1920 on one of the pages of the Website.
    8. Services (Service) - the Service or Services provided by Dolfi1920 in accordance to the terms set out in General Terms and Conditions.
    9. Account Owner - the User who created the Account.
    10. Agreement – a contract for the provision of electronic services concluded between the User and Dolfi1920. The Agreement comes to life upon the User's acceptance of the Regulations, with the content of the Agreement corresponding to the content of the General Terms and Conditions.
    11. Regulations – The General Terms and Conditions specified in this document.

General provisions

  1. Regulations define the rules of using the Website and the Services offered by Dolfi1920, as well as the scope of rights and obligations of Dolfi1920 and the User.
  2. The owner of the Website and the entity providing the Services indicated in the Regulations is Dolfi1920.
  3. By using the Website and on the terms set out in the Regulations, Dolfi1920 provides services (i) to airlines in the area of passenger claims for damages to luggage during the journey, (ii) warranty repairs of products from cooperating manufacturers and (iii) private repair of damaged suitcases.
  4. Access to the Account and Services offered by the Website is available only to the Users who have registered their Accounts in the manner specified in the Regulations.
  5. The condition of using the Website and the Services provided by Dolfi1920 is to read the Regulations and express the User's consent to the conditions set out in the Regulations.
  6. Dolfi1920 will make every effort to ensure the security of the Internet data transmission being part of the use of the Services , that is, that the information sent is confidential and complete.
  7. Dolfi1920 is not responsible for technical problems or technical limitations of the computer equipment used by the User, which prevent the User from using the Website and the Services offered through it.
  8. Dolfi1920 undertakes to provide services and deliver items free from defects.
  9. Minimum technical requirements of the computer system which the User wants to use to access the Website: 1000 MHz processor, RAM memory: 512 MB, Internet connection, Browser: HTML5, CSS3 and JavaScript support, with Cookie enabled, as well as using mobile devices equipped with an internet browser
  10. The User is in particular obliged to:
    1. use of the Website in a way that does not interfere with its operations, in particular through the use of specific software or devices;
    2. no to supply or post on the Website content prohibited by the provisions of the applicable law;

The rules of using the Website

  1. Dolfi1920 informs that access to the Services is possible after registering the Account on the Website, and thus leaving the User's personal data on the Website, as described in this section of the Regulations, as well as after meeting other conditions indicated in the Regulations.
  2. User registration as part of the Website, and thus the creation of an Account, takes place by completing the claim register form available on one of the Website pages.
  3. Completion of the claim register form requires at least the following data to be provided by the User: email address, first and last name, telephone number.
  4. By registering, the User is obliged to provide truthful, accurate and current data that is not misleading and infringing the rights of third parties. In addition, the User is responsible for maintaining the proper confidentiality of the Password.
  5. The User bears sole responsibility for the content of the data provided by them. Dolfi1920 informs that all content sent or any Orders placed by third parties that identify themselves with the User's Login and User's Password will be assigned to the User.
  6. The User's access to the User's Account and the use of the Services provided by Dolfi1920 through the Website is possible after logining into the Website by using the correct Login and Password.
  7. Repair ordered can be submitted 24 hours a day / 7 days a week.
  8. In order to submit a claim registration form, the User may be asked to provide some information such as:
    1. a file reference number (in the case of a claim for damage luggage during air travel),
    2. selecting the type of product to be repaired - it is possible to submit several products when filling out one form
    3. other information such as: model, brand, age, price and date of purchase of the product submitted for repair as well as the type of damage,
    4. Pictures of damages
    5. in the case of a warranty repair, the User may be asked to attach a copy of the warranty card, proof of purchase, or provide the serial number of the suitcase.
    6. After completing the claim register form, the User will be updated about the status of the order.
    7. In the situation when the User is offered a solution in which the User will be able to receive a new product, the user can also choose a different product than the one that was proposed.. This may involve additional costs on the part of the User - depending on the choice made. In order to make the selection, the User is redirected to the online store.

Price and payment

  1. Payment and currency Dolfi allows the Users the option to select the destination country before placing the order, so that they can see the prices with the corresponding taxes included. If the User subsequently modifies the delivery address and the destination country, the prices displayed in the final summary of the order may vary.
  2. Value Added Tax
    1. In accordance with the current legislation, the sales will be subject to VAT, applying the current VAT rate in the Member State in which the goods are to be delivered.
    2. According to the legislation, when the purchaser is liable for VAT in an EU Member State, it may be possible to apply the “reverse charge” mechanism subject to the requirements established in the legislation. In this case, the transaction will be exempt from VAT if the customer applies the “reverse charge” mechanism.
  3. Payment methods
    1. Dolfi1920 only accepts payment by credit or debit card (Visa, Visa Electro nor MasterCard) via PayOne or via PayPal.
    2. For payments by credit or debit card, the charge will be made online, that is, in real time, through the payment gateway of the corresponding financial entity, once it has been confirmed that the data sent by the user is correct.
  4. Payment security
    1. In order to offer maximum security in the payment system, Dolfi1920 uses the secure payment systems of the leading financial entities in e-commerce. Thus, all confidential data is transferred directly and in an encrypted format (SSL) to the corresponding financial entity. For payment by Visa and MasterCard, Dolfi1920 only accepts SET transactions (Secure Electronic Transactions) using the 3D Secure international protocol, which can be identified by the Verified by Visa and MasterCard Secure Code logos. The basic aim of the Secure Electronic Transactions initiative is to guarantee the security of Internet transactions. When the User makes a payment through the secure payment gateway, the system will automatically check whether the credit card has been activated for Secure Electronic Transactions. Next, it will connect with the card’s issuing bank , which will request authorization for the operation via a personal authentication code. The operation will only proceed if the card’s issuing bank confirms the authentication code. In all other cases, the transaction will be rejected. Dolfi1920 possesses the GeoTrust SSL safety certificate for online transactions.
    2. Dolfi 1920 reserves the right to check the personal details provided by the Users and to take the appropriate steps (including the cancellation of the order) to ensure that goods are dispatched in accordance with the data that is stated on the order.

Personal Data Protection

  1. Dolfi1920 takes special care of the privacy of personal data and information regarding current and potential customers. Below, we provide general information about the rules for the collection, processing and use of your personal data by Dolfi1920.
  2. The administrators of personal data provided by the User are:
    1. Airlines for which Dolfi1920 provides suitcase repair services,
    2. Manufacturers for which Dolfi1920 provides warranty services,
    3. Dolfi1920 Services sp. z o.o., Konstruktorska 13, Warsaw - in the scope of personal data necessary to handle the process of repair or replacement of damaged suitcases (call center),
    4. Dolfi1920 sp. z o.o, Działkowa 33, Warsaw - in the scope of personal data necessary to repair the suitcases (warehouse, service and shipping).
    5. Personal data of the User is processed only for the purpose of carrying out their claim case regarding the repair or replacement of damaged suitcases.
    6. The User's personal data will be transferred between the entities of the Dolfi Group and to the company dealing with the shipment of the suitcases. This transfer will take place only when it is necessary for the User's submission. In particular, the User's data will not be transferred to other entities for marketing purposes.
    7. The User has the right to access their data, update it and correct it.
    8. The User's transmission of personal data to Dolfi1920 is voluntary, but the lack of consent results in the inability to process a claim registration regarding repair or replacement of a damaged suitcase.

Complaints

  1. All complaints related to the Services provided by Dolfi1920 and questions regarding the use of the Website should be sent to the e-mail address info.poland@dolfi1920.pl with the note "Complaint." If the complaint concerns the quality of services, the User is asked to enter internal ID number.
  2. Complaints resulting from non-compliance with the content of the Regulations will not be considered by Dolfi1920.
  3. Dolfi1920 considers the complaint within 14 business days from the day it is received and informs the User, by e-mail, about the method of its consideration. In the situation where the data or information specified in the complaint needs to be supplemented with additional information, Dolfi1920 turns, to the person lodging the complaint to provide the missing information before examining the complaint,. The time of providing additional explanations by the User prolongs the complaint handling period accordingly.

Return and cancellation policy

  1. The refund procedure applies only to products purchased through the online store.
  2. If the User is not satisfied with the purchase, Dolfi1920 allows the return of the product within 30 (thirty) days from the date of receipt provided that the product does not show signs of use and is not damaged. All purchased items returned must be carefully packaged and include a duly completed delivery note or return form.
  3. The return of purchased goods will be carried out through the courier company GLS.
  4. Once the Products are received, Dolfi1920 will inspect that they are in good condition and will reimburse the purchase via the same payment method used in the purchase and in the same amount.
  5. The User has the right to cancel a contract without giving a reason within 14 calendar days. The cancellation period expires after 14 calendar days from the date of purchase.
  6. If the customer exercises the right to withdraw from the contract and to cancel the order, the maximum deadline for refunding the amount paid for the purchased goods will be 14 calendar days from the date of resignation. The reimbursement for the returned items always takes place in the same form of payment and the same amount paid by the User which was used for purchase thereof.
  7. In case of sending by Dolfi1920 a different article of luggage than ordered or sending a defective article, Dolfi1920, after confirming the error or poor quality of the article, will reimburse the amount due for the returned item in the same amount of payment collected from the customer and will cover the costs of its shipping.
